Customer Declarations You declare that 1.1. You are over the legal age of 18 years. 1.2. You are one of the registered owners of the property at the installation address and your name is on the title deed of the installation address. 1.3. You have never received or have never been approved for any Government rebate, financial assistance solar credit or Small Scale Technology Certificate (STC’s) for small generation solar power system at the installation address.
Payment & STC’s 2.1. ASC must have the final payment prior to OR on the day of the installation by Credit Card or Cheque. If you prefer Electronic Fund Transfer (EFT), the transaction must be completed 48 Hours prior to installation. The customer must provide Credit Card details / Cheque / EFT receipt to ASC prior to the installation, failure to do so will result in cancellation of installation and any fees applicable for rescheduling the job will have to be paid by you. 2.2. You are agreeing to pay ASC the STC’s as part payment for your solar PV system. The STC’s will be paid directly to ASC or an ASC Agent. If the office of Clean Energy Regulator (www.retdeanenergyregulator.gov.au) determines you are not eligible to receive STCs, and therefore ASC is unable to receive the STC’s as part payment, you will be liable to pay ASC the value of the STC’s, as per the market rates. 2.3. If you are not eligible for STC’s, or if you wish to claim the STC’s incentive yourself, the complete payment (including trading costs of STC’s) of the system is due to be paid in full before installation. 2.4. You acknowledge that if you breach any conditions of the STC’s incentive regulations, you may be financially liable to the Office of Clean Energy Regulator (www.racleanenerevregulatoreov.au) If you commit any breach of the incentive regulation, you acknowledge that ASC will not be liable to you. 2.5. ASC or an ASC Agent will arrange for the complete documentation and processing of the sale of STC’s. You acknowledge that price of STC’s is governed by market movements and the REC guidelines. If the market price falls below a certain price, ASC may decide to delay the installation until the price rises to a level which was used to calculate the quoted price. ASC may also refuse to carry out installation and refund your deposit in full. If the market price of STC’s falls below the price that was used to calculate the quoted price, which is determined by ASC at its absolute discretion. 2.6. If you fail to pay any amount that is due and payable under this agreement, ASC will be entitled to charge interest on the unpaid amount at the current Reserve Bank target cash rate plus 2%. You will also have to pay ASC any costs associated with the recovery of such unpaid amounts. 2.7. Title and ownership of the solar power system will be transferred to you upon ASC receiving payment in full from you for the total agreed cost. 2.8. Failure to pay the amount in full may result in ASC taking legal action against you and it will null and void all warranties.
Authority of access to property 4.1. You authorise ASC and its contractors, employees and installers, full access to the property at all reasonable times to carry out all work associated with the installation of your solar power system including site Inspections, the signing of required paperwork, the delivery and installation of the solar power system, and connection to the grid. 4.2. Your co-operation is required to enable site inspections/installation to occur at the earliest possible time that is convenient to ASC.
Liabilities and Risk 4.3. The ownership and insurance risk of the solar power system if transferred to you once installation has been completed, and ASC receiving full payment for the solar power system. It Is your responsibility to ensure that your property insurance adequately covers the cost of your solar power system. 4.4. You acknowledge that ASC has no liability or responsibility for your STC’s incentive as administered by the Office of Clean Energy Regulator (www.retdeanenergyregulator.gov.au). 4.5. You acknowledge that ASC accepts no liability or responsibility for your STC’s Bonus, also known as the “feed in tariff incentive’ as administered by the relevant State or Territory government” 4.6. ASC accepts no responsibility for any damage or loss caused to your property by the installer which has not been caused by the installer’s negligence. All ASC. installers are subcontractors who are required by ASC. to have appropriate third-party damage insurance, under relevant state and territory laws. ASC will work with you and the installer to rectify any damage caused to your property by the installer’s negligence. 4.7. You acknowledge that ASC. will not be responsible for any damage caused to old and brittle roofing tiles that may be cracked or damaged during installation 4.8. ASC accepts no responsibility for any additional costs associated in obtaining an upgrade of your existing meter box upgrade or the installation of a new gross/net meter. 4.9. ASC, will not be liable for any unexpected costs which may arise in relation to the removal and handling of asbestos at your property in relation to the installation of the Solar power system.
Meter 5.1. ASC. quote does not include the costs of any wiring or any associated work required to connect your inverter to a meter box which is remotely located from the inverter, (i.e. where the meter box is not attached to the same structure as the inverter such as the house or the garage.) In the event that the meter box is located remotely from the inverter’s location, any such costs are not provided for in the relevant ASC. quote, you will be required to arrange and pay for any such electrical works separately from installation of the Solar power system. 5.2. Additional minimum charges may be applicable such to split the system in more than one row, for horizontally fixing array, and any extra charges for a meter box upgrade. Such additional will be listed on the contract/quote.
Delivery and Installation 6.1. ASC. will make every reasonable effort to install your system in a timely manner. However, ASC will not be bound to meeting estimated or proposed delivery installation or system completion dates as we have no control over worldwide materials availability, peaks in demand created by changes in government legislation, inclement weather and/or other forms of force majeure. Delayed installation or grid connection is not a valid reason for claiming a refund or compensation from ASC. 6.2. ASC is not responsible for any delays in installation if customer details including installation site are incorrect. 6.3. Delays in installation are not grounds for cancelling this contract and ASC. is not liable to you for any perceived loss as a result of such delays. 6.4. If difficulties with site access are encountered that were not notified to ASC at the time of this contract and/or offered by ASC to the customer, addition costs incurred in ensuring the safety of our installers may be payable by you. 6.5. Before the installation can commence, and modifications to your roof takes place, you are required to pay any outstanding payments of the solar power system, and till such time the goods remain the property of ASC until your payment or finance payment (if applicable) is received in full. 6.6. A home owner must be present during installation to sign the mandatory declaration assigning the STC’s to ASC, as per the renewable Energy Act (2000) should the installer arrive on the agreed data and the home owner is not present, rescheduling fee of $200.00 will apply and the installation will be rescheduled. 6.7. If you have any preference regarding panel/inverter placement, you are required to inform the installer prior to the commencement of installation. 6.8. If you have any minor present at the property during the time of installation, you are required to authorise an adult to be present at the property to sign all document and assume complete responsibility. 6.8. Upon signing this agreement, any requests for modifications to the material/equipment will incur an admin charge of $200, and a new quote will be provided to you for any changes required.
Privacy Policy 7.1. You agree to provide ASC with any personal information required for ASC to act on your behalf, in particular for the accurate completion of paperwork for the STC’s incentive (selling the STC’s) and a network connection to the grid. 7.2. ASC will provide your Information to its contractors, employees and installers only as required to effectively perform their duties. 7.3. ASC will provide your information, on your behalf to relevant public/private organisations for the processing of STC’s incentive (selling the STC’s), to the electricity distributor for connecting your solar power system to the grid and if required to your electricity retailer. 7.4. Unless otherwise agreed with you. ASC will not provide your personal information to any third parties other than those mentioned above. 7.5. ASC will not sell your personal information under any circumstances. 7.6. You authorise ASC to use any imagery or video material of you or your property for the purposes of maketing on ASC’s website or print publications.
Product Warranties 8.1. The solar power system comes with an installation warranty from ASC, and lifetime of such warranty is specified in the quote. The warranty will void in case the installation has been modified or tampered with by any other person apart from ASC and its authorised sub contractors. 8.2. It is absolutely forbidden to modify the solar power system which is not carried out by ASC or any of its authorised sub contractors. Any modification, manipulation, or alteration not expressly agreed with ASC, concerning either hardware or software, shall result in the immediate cancellation of warranties. 8.3. ASC does not provide any kind of warranties on the monitoring system that comes with the inverter. 8.4. Warranties on panels and inverters is limited to what has been provided by their respective manufacturer, and any warranty claims should be directly communicated to the manufacturer.
Cooling off Period 9.1. You understand that under Australian Consumer Law and relevant State Building Act you are entitled to a cooling-off period of ten (10) business days. 9.2. A notification to cancel the contract during cooling-off period must be received by ASC in writing via email or post within 10 business days. 9.3. The cooling-off period begins on the first business day when you sign and receive this contract.
Finance Financing is not available on advertised specials. Terms and Condition of repayment of finance and interest will be provided by the Finance Company.
Termination 11.1. ASC may terminate this contract with you if any of the following occurs: 11.1.1. You do not abide by any of the terms and conditions listed in this document. 11.1.2. There are delays in the ASC process causing supplier prices to increase in which case full deposit will be refunded. 11.1.3. ASC has complete authority to cancel the installation, if installation cannot be made possible, in such case ASC can refund your deposit in full. 11.1.4. You may terminate this contract within the cooling-off period, and you may be eligible to get a refund of your deposit after deducting any administrative charges. ASC normally procure the material or equipment within one week of receiving a signed copy of the contract. You are liable to pay cost of any materials if the contract is cancelled after cooling-off period.
